In July of 2012, Stryker Orthopaedics and its parent company, Howmedica Osteonics Corp., recalled its Rejuvenate hip replacement. The hip implant was only in the market for two years; however due to the numerous reports of patients suffering significant complications as a result of the medical device a voluntary recall was issued.
It has been estimated that 20,000 patients did in fact have the Rejuvenate hip implanted. There are currently around 1,000 complaints filed against Stryker and Howmedica for injuries associated with the Rejuvenate and ABG II hip replacements. Approximately half of all the Stryker lawsuits are pending in New Jersey state court, where the headquarters of Howmedica is located. It is one of the largest mass tort cases in the country and has been consolidated into multi-county litigation (MCL).
During the early stages of litigation, ten Stryker hip lawsuits were selected to assist in reaching settlements with injured patients. At least four of the ten Rejuvenate claims have been settled. The settlement amount is confidential, however it is estimated that there will be a payout greater than $1 billion in Stryker hip lawsuits.
Mediations for other cases are expected to begin this month.
